Terms of Use

Last updated 25 October 2026

These terms are the agreement between you and SecretSwapp when you use our website or mobile app. By creating an account, joining a Swapp or otherwise using SecretSwapp you agree to them and to our Privacy Policy. If you don't agree, please don't use the service.

1. Who can use SecretSwapp

You must be at least 13 years old and able to enter into this agreement. If you use SecretSwapp for a group or organisation, you confirm you may do so on its behalf.

2. Your account

Give us accurate information, keep your password secret, and tell us promptly if you think someone else has used your account. You are responsible for what happens under your account. You can join someone else's Swapp as a guest without an account, using the link they share; the link we email you is personal, so please don't share it.

3. Swapps

  • Hosts decide the group size, rules, budget and dates. Please set them honestly and be considerate of the people you invite. You can change the group size while a Swapp is open, within the limits shown in the app. Once names are drawn, a draw can't be undone.
  • Participants should give a real name and email address, a wish they are comfortable sharing with their gifter, and should only join a Swapp they actually intend to take part in.
  • We provide the tools to organise and draw names. We don't buy, handle, ship or guarantee any gift, and we aren't a party to the exchange between participants. Gifts are given and received at the participants' own responsibility.
  • Matches are made at random, or - with Smart match - with AI suggestions that we verify. We don't promise that a match will suit anyone's taste or budget.
  • For fairness, nobody - including the host and our team - can see the full list of who is gifting whom.

4. What you may not do

Don't use SecretSwapp to break the law, harass or threaten anyone, send spam, impersonate someone, collect other people's personal information, or put anything harmful, hateful or sexually explicit in a Swapp. Don't create fake accounts or sign-ups, try to get around limits or security, probe or disrupt the service, or use automated tools to scrape it. We may remove content or suspend accounts that break these rules.

5. Your content

You keep ownership of what you add (titles, messages, wishes, pictures, reports). You give us permission to store, display and send it as needed to run SecretSwapp - for example, showing your wish to your gifter and showing a Swapp's title and picture to people who open its link. Only add content you have the right to share.

6. Ambassador and influencer programme

  • Ambassadors and influencers can create sign-up codes and earn points when people they refer join, verify their email and start using SecretSwapp.
  • Points have no cash value, can't be transferred or sold, and can be exchanged only for the rewards we list, while stock lasts. Rewards are approved by our team before they ship.
  • We may withhold, adjust or reverse points, and suspend codes or accounts, where we reasonably suspect abuse - for example referring yourself or your own aliases, creating fake or duplicate accounts, or other artificial activity.
  • We may change the point values, rewards and rules, or end the programme, at any time. We'll apply changes going forward.

7. Emails and notices

We email you about things you do on SecretSwapp - confirmations, sign-in codes, Swapp updates, your match and support replies. These are part of the service.

8. The service can change

We work to keep SecretSwapp available and accurate but can't guarantee it will always be uninterrupted or error-free. We may add, change or remove features, and may update these terms; if we make a significant change we'll tell you, and continuing to use SecretSwapp after that means you accept it.

9. Our responsibility

SecretSwapp is provided "as is". To the extent the law allows, we aren't liable for indirect or consequential losses, for gifts that are late, missing, unsuitable or never given, or for what other people do. Nothing in these terms limits liability that can't legally be limited, including for fraud or for death or personal injury caused by negligence.

10. Ending things

You can stop using SecretSwapp at any time and ask us to delete your account. We may suspend or end access if you break these terms or to protect other people or the service.

11. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria will have jurisdiction, without affecting any rights you have under the consumer laws of the place where you live.

12. Team Swapps (paid)

A team Swapp is a Swapp you pay for, so you can invite up to 300 people by e-mail. These extra terms apply to it, and are summarised in the approval you are asked to read and accept before you pay.

12.1 The fee

The fee is ₦1,000, paid once, for one Swapp. Paystack, who take the payment, charge a processing fee, which we pass on at cost and show as its own line before you pay. We add no service charge of our own. Prices and fees are shown in naira, and the exact amount is shown on the last step and on your receipt.

12.2 No refunds

The fee is non-refundable. Once you have paid, that Swapp is yours to use. The payment can't be moved to another Swapp, exchanged or returned, including if you cancel the Swapp or don't use all of it. This doesn't limit any right you have under the law. If a payment is taken but can't be applied (for example, the amount received doesn't match), we will refund it.

12.3 People and invitations

A team Swapp holds up to 300 people and is invite-only: each person you add gets an e-mail with a personal link, and only people on your list can join. You can choose your own link (the part after /s/), subject to the rules in the app; we may refuse, change or release a link that breaks the rules, imitates someone, or is offensive.

12.4 Your responsibility for your list

You confirm that you have the right to give us your team's names and e-mail addresses, and that the people on your list would expect to hear from you about the gift exchange. You are responsible for the accuracy of your list and for anything you write in your invitation note. In privacy-law terms you decide whose information is added and why, and we handle it for you, as set out in the Privacy Policy.

12.5 How invitations are sent

To protect people's inboxes, invitations are sent within a daily limit per host, which is shown on your invite page. You can load your whole list at once; invitations that have to wait go out automatically. We may change the limit, and may lift it for a Swapp when asked. Every invitation names you, sends replies to you, and has links to say it isn't for the recipient or to report it.

12.6 Deleting your team's data

Your team's names, e-mail addresses, wishes and matches are deleted automatically 7 days after your gift exchange (or 7 days after you cancel), and you can delete them sooner from the Swapp's page. We keep the Swapp's title, dates and counts, and our payment record, which holds nothing about your team. A team Swapp therefore needs a gift exchange date, and we may ask you to choose a date no more than about 13 months ahead.

12.7 Acceptable use

Use a team Swapp only for a real gift exchange among people who know you. Don't use it, or its link, invitation note or name, to send spam, to pretend to be a bank, an authority or another person or company, to phish for information or payments, or for anything else that is unlawful or harmful. If an invitation is reported, or we believe these rules are broken, we may switch the Swapp off, remove its link and stop sending its invitations, without a refund, and we may close the account.
